The Act on the Transport of Dangerous Goods of August 19, 2011 (Article 15) requires each participant in the transport of dangerous goods to appoint at least one adviser for the safety of the transport of dangerous goods, competent for the scope of the transport or related activities. The obligation to appoint an adviser also arises from Chapter 1.8.3.1 of the Regulations concerning the International Carriage of Dangerous Goods by Rail (RID), which constitutes Annex C to the Convention concerning International Carriage by Rail (COTIF).

A participant in transport, in accordance with Chapter 1.4 of the RID, is:

  • Consignor;
  • Carrier
  • Consignee
  • Loader
  • Packer
  • Filler
  • Tank container/portable tank operator
  • Tank-wagon operator
  • Railway infrastructure manager
  • Unloader
  • Entity in charge of maintenance (ECM)

The transport participant is obligated to train persons performing activities related to the rail transport of dangerous goods, employed by them, or performing activities related to the transport of these goods on their behalf, to the extent appropriate to their responsibilities and obligations. Transport participants are also obligated to submit an annual report prepared by the advisor to the President of the Office of Rail Transport (UTK) and to archive these reports for a period of 5 years. Failure to appoint an advisor, failure to train persons involved in the transport of goods, or failure to submit the report may result in a fine of up to PLN 5,000.

Consulting services for the rail transport of dangerous goods includes:

  • internal audits in the company;
  • employee training;
  • identification of dangerous goods;
  • classification of dangerous goods and hazardous waste;
  • verification of safety data sheets;
  • checking the correctness of the transport documentation
  • preparation of transport documents;
  • streamlining customer costs by using available exemptions (e.g., 3.3, LQ, 1.1.3.6);
  • preparing dedicated internal procedures, instructions, and checklists for packaging, filling, consigning, loading, unloading, transporting, and receiving goods;
  • development of shipping instructions for designated UN numbers;
  • assessing compliance of the transport of dangerous goods with legal regulations;
  • preparing accident reports;
  • preparing annual RID reports.
